Candidate List of Substances for Eventual Inclusion in Authorisation process

On June 18, 2010 the European Chemicals Agency (ECHA) has added 8 substances to the Candidate list of substances for eventual inclusion on the Annex XIV List of Substances subject to Authorisation on its website. This brings the total number of Substances of Very High Concern (SVHC) on the Candidate List to 38.

Following this publication, the requirements of Articles 31.1(b), 31.1(c), 31.3, and 33 may apply.

According to our records, no ExxonMobil products contain a Candidate List substance that triggers the obligations under Article 31.1b or 31.3, except those listed in the attachment. The substances listed in the attachment will therefore be identified in section 3 of the Safety Data Sheet. Similarly, ExxonMobil has received no notification from suppliers indicating the presence of a Candidate list substance in the products which we purchase.

Article 31.1.c requires that the supplier of a substance or a preparation shall provide the recipient of the substance or preparation with a safety data sheet (SDS) where a substance as such or as part of a preparation is included in the Candidate list on the basis that the substance is of equivalent concern per Article 57(f). No substance has been added by ECHA on the Candidate List on the basis of equivalent concern per Article 57(f)

Article 33.1 requires that any supplier of an article containing > 0.1 wt% of a substance on the Candidate list shall provide the recipient of the article with sufficient information, available to the supplier, to allow safe use of the article including, as a minimum, the name of that substance. Article 33.2 requires similar information to be provided to consumers upon request. According to our records no articles manufactured by ExxonMobil contain a Candidate List substance that triggers the obligations under Article 33.1 and 33.2. Also, to date ExxonMobil has received no such information from suppliers of articles.

Based upon the above and the information currently available, we have no evidence that any products or articles supplied by ExxonMobil within the EU contain any of the substances identified on the Candidate List at > 0.1 wt% with the exception of the product(s) listed in the attachment(s).
